Last Will & Testament
The cornerstone of every estate plan, a Last Will & Testament allows you to distribute your assets, name guardians for your children, and appoint executors (legal-ease for a person you trust to carry out your will). With Simply Free Legal, you can even appoint a pet caretaker, bequeath digital assets like a music library or social media account, and specify your funeral or memorial instructions.

Please remember a few things as you complete the below form. First, please be sure that you're ready to complete your Last Will at this time. If you execute it and later decide to make changes, you will need to execute a formal amendment (called a Codicil). Second, you do not have to own something currently to bequest it. For example, you can state how any property you may own at the time of your death should be distributed. Finally, the remainder (or "residue") of your estate includes all assets you did not specifically bequeath. Also, if all the beneficiaries and alternate beneficiaries of an asset you specifically bequeathed predecease you, that asset is distributed along with the residue of your estate. It's generally a good idea to list at least one alternate beneficiary for each asset.

We will contact you with any questions or concerns. You will receive a PDF copy of your Last Will via email. The email will include your state's requirements to validly execute your Last Will. Our Scanned Access service allows you to upload a scanned copy of your signed Last Will and grant view-only access to your executor(s), beneficiaries, or anyone you'd like. View-only access means they won't be able to edit or tamper with your Last Will. You'll be able to revoke their access or grant additional view-only access with the press of a button.
It may be better for your executor(s) and beneficiaries to view your Last Will now. This will allow them to ask clarifying questions about your intended bequests--you may find that something wasn't expressed as clearly as it could have been. Also, granting view-only access to all your beneficiaries prevents a scenario where one beneficiary isn't told about your bequest to them because of a dispute or animosity. Your wishes are carried out exactly as you mean them to be.
With our Hardcopy Custody service, you mail your original Last Will to us. We will securely store it until your death. Please tell your executor(s) that Simply Free Legal has your original Last Will & Testament by, for example, granting them view-only access to your Last Will by logging in to your Simply Free Legal account (Hardcopy Custody purchasers get everything that's included in the Scanned Access package). Upon your death, your executor can simply send us a photo of his or her driver's license or other government-issued identification, along with a copy of your death certificate, and we'll mail the original hardcopy of your Last Will to your executor. Alternatively, if you cancel your Last Will (by, for example, creating a new one), we will securely destroy this version. Finally, we will scan a copy of your Last Will for you to access anytime you'd like, and you'll be able to give others the ability to view the scanned copy as well.
